Preamble
The general terms and conditions are the basis for business transactions with our customers. They simplify, speed up and standardize the conclusion of contracts through a pre-formulated set of rules. For merchants within the meaning of the German Commercial Code (HGB), they shall also apply to future business relations without the need for an express agreement.
§ 1 Confidentiality
All information and documents provided by us, including our property records, are intended exclusively for our customers and may only be passed on to third parties with the written consent of Niklas Storch, Immobilien Storch. Contraventions may oblige the passing on party to pay the commission in the originally agreed amount in the event that a main contract (rental/purchase contract) is concluded.
§ 2 Data protection
The Client expressly agrees that Niklas Storch, Immobilien Storch is authorized to process the necessary personal data of the Client in accordance with the statutory provisions in order to fulfill its obligations.
§ 3 Limitation of liability
We would like to point out that the property information, documents, plans etc. provided by us originate from the seller or landlord. We therefore accept no liability for the accuracy or completeness of the information. It is therefore the responsibility of our customers to check the correctness of the property information and details contained therein. Otherwise, Niklas Storch, Immobilien Storch shall only be liable in the event of intent, gross negligence, lack of guaranteed characteristics or culpable breach of a cardinal obligation; otherwise in accordance with the statutory provisions.
§ 4 Conclusion of Contract / Commission
The commission claim of the broker arises with the conclusion of the legally effective main contract. The commission is earned and due as soon as the main contract (rental/purchase contract) has been concluded. It is payable within 7 calendar days after invoicing. If the desired main contract should come about through our proof or mediation activity, a commission is to be paid by the client to Niklas Storch, Immobilien Storch. Both the amount of the commission and the respective payment by the client shall depend on the location of the property and the commission customary there, unless a different commission rate is expressly stated in the respective offer.
§ 5 Dual activity
Niklas Storch, Immobilien Storch is also entitled to act on behalf of the other contracting party subject to commission.
§ 6 Enquiry Clause
In relation to the owner of an object that has been given to us for brokerage, the owner is obliged to ask Niklas Storch Immobilien Storch whether the intended contractual partner has been induced by our activities before concluding the intended main contract (purchase contract or rental contract) stating the name and address of the intended contractual partner.
§ 7 Follow-up business
A commission claim Niklas Storch, Immobilien Storch also exists in the case of follow-up transactions which have been concluded within a temporal and economic context since the original contract. A follow-on transaction occurs when an extension or change to the contract opportunity occurs.
§ 8 Place of jurisdiction
If our customer is also a merchant within the meaning of the German Commercial Code (HGB), the agreed place of jurisdiction shall be Bad Homburg v.d. Höhe, Germany. German law shall apply.
§ 9 Severability clause
Should one or more of the above provisions be or become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced between the parties by a provision that comes as close as possible to the economic interests of the contracting parties and otherwise does not contradict the contractual agreements.
